Answer to the Question

What is a short sale? What is involved with buying a short sale?

Four years ago, short sales were a rarity. Today, in some neighborhoods, they make up the majority of what is on the market. What has changed in four years? There's been a huge learning curve, but at the very least, we've learned what questions to ask and which answers we need to hear. There is one constant - 95% of short sales are difficult, but you should know what short sales are and what's involved. You can then decide whether they are good or bad for your particular situation. There are strong positives for the short sale buyer, but often, the negatives outweigh those upsides. So in defining short sales, let’s start with these bullet points:

  • The home owner owes more to the bank than what the home is worth.
  • Instead of letting the bank take over the home (foreclosure), the home owner will try and sell it as a ‘short sale’, the ‘short’ meaning the bank (if the bank agrees) will be receiving less than what is owed.
  • The homeowner still owns the home during the short sale process, but the bank makes the final decision on the sale terms.

Ok, so now you know the basics. Here’s the ‘why’:

  • Usually a seller attempts a short sale because the home owner has fallen on bad times, usually the loss of a job.
  • If the homeowner lets the home go into foreclosure (bank takes over home from the seller), the hit against their credit report is much worse than if they sold it as a short sale.
  • Banks don’t want to take over the property, it's very expensive for a bank to take possession of a home.
Sounds like it could be a good deal for a home buyer, doesn't it? Quite often, the answer is 'yes', but there are several black holes that can happen along the way. In order to explain, we'll tell you a story. Debra Homeowner owns 123 First Home Dr. and 1st National Bank is the lender who still has a claim (lien) on 123 First Home Dr. because Debra used 1st National Bank as her lender to buy the home and she still owes a balance to 1st National Bank. Debra needs to sell the home and her and her real estate agent believe the home is worth $200,000 if it was a normal sale, $150,000 as a short sale. The problem is Debra owes $250,000 to 1st National and she just got laid off. She decides to sell it as a short sale and they list the house at $160,000. Jake Homebuyer comes along and offers $150,000. Debra and her agent thinks the offer is solid enough for the bank to accept it, so Debra signs the contract at $150,000. The contract goes to the bank and now they wait for 1st National to (a) accept the offer, (b) reject the offer, (c) come back with a counter offer. The wait time for this can be anywhere from 2 - 9 months, that's not a typo.

The above paragraph is about as simple as it gets. Remember, the bank doesn't want to take over the property - too expensive. After a contract is submitted, most banks pay a real estate broker (called a BPO, Broker Priced Opinion) to appraise the home and if it's close, they usually take it. But not always, and again, beware of the length of time. Here are SOME blackholes you might find during the short sale process (all of which have happened in the past 12 months):
  • Too many liens on the property, can't get everyone to agree - needs to go into foreclosure. Waited 6 months for this answer.
  • Person handling the file at the bank quits her job, now the file is with someone who now has 2X the amount of short sale files that they had before and they have to train the new person when that person is hired.
  • BPO is bad, broker is out of area. Bank wants too much money for the house. Waited 5 months for this information.
  • Condo associations. How much is owed and what are they willing to accept? Buyer paid out of pocket for past due assessments (they didn't have to, they could have walked away, but the deal was still good enough).
  • Everything goes smooth and the day of the closing during the walk-through all the appliances are gone - the sellers stole them out of the house.
These are just our stories from the past year, you'll get several more stories from others. Some go without any issues, most do not. Some of those problems can be avoided if your agent knows what to look for, but most problems arise where it's out of anyone's control or foresight. In the end, if you do get one, you can get a great deal. Just be prepared to wait and be frustrated.

Affordability Calculator - CNN Money


The question does come up quite a bit, 'How much of a housing payment can I afford?'. Our answer is one that centers around your particular lifestyle. Do you eat steak every night for dinner? Do you take several vacations a year? Are you having a child soon and expecting to utilize a day care center? There are several other factors to consider, but we found this great calculator on CNN Money's website as a way to at least see how the banks interpret what it is you can afford: click here.

We've seen people with housing payments at 20% of their gross income and we've seen people push that upper limit. Take an honest look at what it is you like to do and how you spend your money. This is your first home, don't go broke - find the right investment.

Harris Going FHA

Harris Bank has officially announced that they are now handling FHA loans. We’ve been in contact with several Harris loan officers and all of them are very excited to offer this loan program. Here’s a link to the portion of their site that talks about FHA loans.

  • 30 Year FHA - 4.25%
  • 30 Year Conventional - 4.25% (must meet top rated guidelines)
  • 5/1 ARM FHA - 3.125%
  • 5/1 ARM Conventional - 3.125%
As alsways these rates change on a daily, almost hourly basis. Are these rates the lowest in US history? Yes.

Chicago Park Feature - Portage Park


One day a couple of weeks ago, I was waiting on a client in the Portage Park area and I decided to hang out a bit in the actual park. It then dawned on me that we need to feature Chicago parks and the real estate market surrounding these parks. Parks in Chicago are a true treasure and we won't be able to capture all that each has to offer in a paragraph, but it might cause you to take a drive and check it out.



Here are the details on Portage Park:
  • Location - Actual Address is 4100 N Long, a decorative entrance is located at Irving Park (4000 N) and Central (5200W).
  • Size - 36.5 Acres
  • Features - One Olympic size pool, one smaller heated pool, six tennis courts, two playgrounds, a slab for in-line skating, a bike path, a nature walk, five baseball fields, two combination football / soccer fields, and two field houses.

Real Estate statistics for Portage Park area as of August 18th, 2010. Active, sold, and under contract within 3/4's of a mile from the center of Portage Park:
  • Condos and Townhomes under $350,000 - 11 sold, 51 active, 5 under contract, average sale price = $135,309
  • Single Family Homes under $450,000 - 67 sold, 86 active, 31 under contract, average sales price $230,273
  • Two to Four Flats under $450,000 - 26 sold, 50 active, 10 under contract, average sales price $221,230
As always, the advice is if you're looking at single family homes in the city, consider 2-4 flat buildings. There are plenty out there and they can be great investment.


Battery Back Up Systems for Basements


Finished basement or looking for a home that has one? This section, written by our agent Tammy Hufford, contains vital information on basements and battery back systems.

Many homes with basements will experience at least one flood. There are various reasons that basements flood: cracks in the foundation, sump pump failures and power outages. However, many people enjoy the extra space that basements provide in a home. Whether using your basement for storage, an unfinished extra room, or a professionally finished theater with all the latest and greatest technology, you will want to make sure that your belongings are safe from damage.

A basement waterproofing company can repair and seal cracks in the foundation, and if necessary, also install a drain tile system around the parameter of the basement. A drain tile system consists of running perforated piping around the parameter of the basement walls, covered with gravel and then topped off with a gravel cover. The piping directs the water to the sump pump in most cases in this area. These companies usually provide a lifetime warranty on their work, but always make sure to ask. Permaseal and US Waterproofing are the two big companies in the area.

A sump pump is installed in a sump pit in the basement or crawl space of a home and it is used to remove water from the pit. The water enters the pit from either rain or ground water, or the drain tile system. Sump pumps generally run well, and it is one of those things that you may be aware is there, but can many times be an out of sight, out of mind piece of equipment. However, if you have ever experienced a flood because of a sump pump failure, it quickly becomes one of the most important features of your house.

Most sump pumps run on electricity. During a rain storm the sump pump will be working the most. You can usually hear the pump kick on and off many times during a heavy rainfall. However, power outages occur frequently during these storms. If your sump pump is electric and the power goes out, your sump pump will not work. This is why it is very important to make sure your home’s sump pump has a battery back-up system. Battery back-ups can cost about $200-$1200, plus installation. Many handy homeowners can install the back-up themselves. If you decide to do it yourself, just be sure to read the instructions and do your research first. Improper installation can lead to issues with the system working correctly. Also, be mindful to check on the system on a regular basis. Most battery back-ups will have an alert when the battery is getting low, but if it is in a closet or utility room that you don’t frequently go into, you will need to remind yourself to check on it.

When looking at homes, see if the home owner has a back up installed. If so, it might be one more thing you won't have to buy PLUS it MIGHT mean the seller is a smart homeowner that takes good care of his / her home. Most homes we see with finished basements DO NOT have a battery backup. It only takes one storm to live through a serious regret. Here's a couple of links for your information:

Movie Review - Inception

Sometimes great movies are like one hit wonders. I’ve seen some movies and have sworn by the director only to be disappointed by their later films. I saw Momento, one of Christopher Nolan’s earlier films, a few years ago. It was good, but not a standout - not a hit on the radio. For me, it was The Dark Knight. It’s one of the few superhero movies that I believe you don’t need to be an action or superhero fan to enjoy. It was more cerebral and intense than most any other movie that’s come out in the past 20 years - Batman or not. Was that to be Nolan’s one hit wonder? I didn’t think so, the movie was too good.

Still, I was open for failure in my prediction that Inception would be great. In my opinion though, I was dead on. Inception is a great movie. It takes you for a ride and things move so fast, you can’t catch it all. I was reminded of Syriana, a movie where confusion was almost a character in the film, and if you tried to figure it all out, you hated it. I think Inception is not quite that deliberate in it's attempt to throw off it's audience. But if you try to know everything that's going on, you won't enjoy it as much.

To write about the plot of the movie and how it unfolds (sometimes literally) would take a novel. But the basics surround the idea that one can enter someone else's dreams. If you can enter someones's mind, and manipulate it a certain way, can you find out something the dreamer doesn't want you, or anyone else, to know? Or, the bigger question becomes, can you influence someone to actually do something in the future? Cobb, played by Leonardo DiCaprio, is the one that knows how to get this done. But as you would suspect, there are so many dark sides to this talent, he's on the run from a few outside, as well as inside, demons. He's entered the private world of dream intrusion and he's given a chance to grab a piece of his life back. But he'll need to dig deep into the psyche of a subject's mind to do what he needs to do, and the only other time he's done that, it shattered his life.

Cobb's team is well cast with Arthur, played by Joseph Gordon-Levitt, Ariande, played by Ellen Page, Eames, played by Tom Hardy, Yusuf, played by Dileep Rao and he gets a little help from Miles, played by the legend Michael Caine. I saw Joseph Gordon-Levitt on SNL about a year ago and was amazed at how talented he was. This guy can do it all, and here he's Cobb's right hand man - but his real value is keeping Cobb in-check and focused. But to me, it was Tom Hardy who was the surprise supporting actor in this movie. Watch his name, you'll see it again. Too much ability crossed with charisma for that guy not to grab his own leading roles soon. This team is assembled to penetrate the subconscious of an individual and convince him he must take action - a different action than what he has set out to do. To perform that act correctly, is called Inception.

Sounds simple? Well, tag on Cobb's baggage and you have one hot mess. His wife, Mal, played by Academy Award winning actress Marion Cotillard, keeps popping in throughout the movie - along with his kids. But there always seems to be a disconnect, and there's a reason why. Even if I wanted to explain it to you, I couldn't. But it intertwines perfectly inside the plot, at least I think so. Some have argued against that conclusion. I can understand it as Inception is like fibers in a cable; there's a whole lot of twisting and turning going but everything moves forward, although some parts not as much as others. Again, just go with it. Like Momento, this movie is truly unique. I stood up clapped at the end of the movie, I haven't done that since I saw E.T. in the theatre. I was 9 years old.
